Conditions of Participation in Competitions

the Wilder Kaiser region

1. Organiser
The organiser of the competition is the Wilder Kaiser Tourist Board, Dorf 35, 6352 Ellmau, Austria (hereinafter referred to as the “Organiser”).

The competition is not affiliated with the respective social media platform (e.g. Facebook, Instagram, TikTok, LinkedIn, etc.) and is in no way sponsored, endorsed or organised by it. The Organiser is the sole point of contact and the party responsible.

2. Participation & Eligibility
Participation in the competition is free of charge and not contingent upon the purchase of goods or services.
Eligible to enter are natural persons aged 18 or over who are resident in the EU or the EEA, unless otherwise stated in the relevant competition announcement.

The following are not eligible to participate:
Employees of the organiser and affiliated companies, agencies involved in the organisation of the competition, and their respective relatives.

Participation is subject to the conditions described in the relevant competition announcement (e.g. commenting, liking, sharing, completing a form, etc.).

Multiple entries, automated entries (e.g. bots), bulk entries via competition service providers or other attempts at manipulation are not permitted.

The organiser reserves the right to exclude participants from the competition in the event of a breach of these terms and conditions or on suspicion of manipulation. In such cases, prizes may also be revoked retrospectively and reclaimed.

Participants are responsible for ensuring that the contact details they provide are accurate and up to date.

Illegal, offensive, discriminatory or otherwise inappropriate content will result in exclusion from the competition.

3. Prize
The specific prize will be announced in the competition terms and conditions.

The prize is non-transferable, non-exchangeable and cannot be redeemed for cash, unless expressly stated otherwise.

Should a prize be unavailable for reasons beyond the organiser’s control, the organiser reserves the right to provide a prize of equivalent value.

Any travel or additional costs not expressly stated as part of the prize are to be borne by the winner.

4. Selection of Winners & Notification
Winners will be selected once the entry deadline specified in the competition announcement has passed.

Unless otherwise stated, winners will be selected at random (by lottery) from among all eligible entrants. Winners will be notified via the relevant social media platform or by email. If a winner does not respond within 48 hours (or the deadline specified in the competition announcement) of being notified, their claim to the prize will lapse and a replacement winner will be selected. This process may be repeated up to three times.

The announcement of the winners is subject to change. The decision is final and no correspondence will be entered into.

5. Changes to or termination of the competition
The organiser reserves the right to amend, suspend or terminate the competition prematurely at any time without prior notice for good cause.

Good cause shall be deemed to exist in particular in the event of:
technical faults, attempts at manipulation, force majeure, legal changes, or platform-related restrictions.

Should damage arise as a result of a participant’s culpable conduct, the organiser shall be entitled to claim compensation.

6. Liability
The organiser shall only be liable for damages resulting from wilful misconduct or gross negligence.

Liability for simple negligence is excluded, except in cases of personal injury or where liability is mandatory under law. The organiser accepts no liability for technical faults, internet outages, platform failures or data loss.

7. Data Protection
By entering the competition, the participant expressly agrees that the organiser may store the necessary data, e.g. first name, surname and email address, for the duration of the competition and beyond. The participant is free to withdraw their consent at any time and thus withdraw from the competition. The organiser points out that none of the participant’s personal data will be made available to third parties. The winner consents to the publication of their name. Rights under the Federal Data Protection Act remain unaffected. Data collected may be used by the organiser and its affiliated companies for market research, newsletter, marketing and advertising purposes.

8. Platform Notice
The competition is not affiliated with the respective social media platform and is in no way sponsored, endorsed or organised by it.

Participants release the respective platform from any liability in connection with this competition.

9. Final Provisions
Should any provision of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.

These Terms and Conditions are governed exclusively by Austrian law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction shall be the competent court at the organiser’s registered office. Legal recourse is excluded.
